Gift Voucher Terms & Conditions
Firstly I would like to thank you for using Foyn Photography Ltd and hope that you enjoy using your voucher. Please review the following information, which will apply to your voucher.
Terms and Conditions for Foyn Photography Ltd gift vouchers.
1. The placing of a gift voucher order implies acceptance (by both the purchaser and the recipient of the voucher of the following Terms and Conditions.
2. Vouchers are non-refundable and cannot be exchanged for cash.
3. If you would like to place an order that is worth more than your voucher amount, you can pay for the difference using either cash or cheque. If the voucher is worth more than the order, the difference will not be refunded and cannot be applied to a future order; therefore if you do not use the entire voucher amount the difference may be lost.
4. Vouchers cannot be replaced if lost, stolen or damaged.
5. Title of the vouchers only passes to you on delivery of payment. If payment is not received (i.e. cheques are dishonoured or payments are recalled) any vouchers despatched will become void and must not be used.
6. Vouchers can be exchanged for a variety of goods which will vary from time to time. Current products will be displayed/listed when confirming the time of the photography booking.
7. It is not permitted to resell or trade vouchers.
8. Foyn Photography Ltd reserves the right to modify any vouchers’ Terms and Conditions.
9. Purchase and supply will be governed by English law. If we are prevented from performing an obligation under the contract by circumstances outside our control we will be released from that obligation and will not be liable for any failure to perform it. In the event of such cancellation, Foyn Photography Ltd will liable only for the fee paid for the vouchers, not for indirect or consequential loss.
10. If an order cannot be fulfilled for any reason, Foyn Photography Ltd will promptly refund the fee paid for the voucher(s).
11. Vouchers must be presented at the time of the booking/photography session. In order to be valid, vouchers must be complete
and unbroken.
12. The date to which each voucher is valid is displayed on it. The voucher cannot be used after this date and will not be refunded if unused.
13. Vouchers are valid for 12 months from date of issue.
14. You must not reproduce in any form the vouchers, or anything deceptively similar to it, or authorise, assist or enable others to do so without prior written consent.
15. We will despatch vouchers to you as soon as reasonably possible after we receive your order, but in any case only upon receipt of cleared funds. Delivery will not be within a given timescale and we will not be liable for any delay in delivery or losses arising from such delay.
16. Upon delivery, you must examine the vouchers and give immediate written notice to Foyn Photography Ltd of any damage, defect or shortage.
17. Foyn Photography Ltd reserves the right to refuse any vouchers which are damaged, altered or defaced.
18. Vouchers will only be accepted bearing a serial number (and name) that matches our records.
19. Only valid in mainland UK (West Sussex for portrait vouchers, unless additional mileage is paid).
20. If an order is cancelled with a coupon/voucher applied, the coupon/voucher may be redeemed again on another order (provided that no costs have been incurred as a result of the cancellation), but will not be refunded as cash.
21. You may change your order if we have not yet despatched the vouchers. However once we have despatched the vouchers you may not change the order. If you do make a change to your order this may result in a delay in despatch.
22. Foyn Photography Ltd may use your details to send you further information on our products and services, to keep you up-to-date on goods, services, new collections and promotional offers you may be interested in or for research purposes. If you prefer not to receive such information or be a part of such research, please write to Foyn Photography Ltd, 42 Rose Green Road, Bognor Regis, West Sussex, PO21 3EP.
23. Where we are in breach of these terms, we will not be liable to you for any indirect or consequential loss, cost, or damage you suffer.
24. Our maximum liability to you arising out of or in connection with your ordering vouchers from us shall be limited to the value of the vouchers which you ordered.
25. Promotional vouchers cannot be used retrospectively, i.e. applied to orders already placed with Foyn Photography Ltd.
26. Please refer to your voucher for the expiry date and any additional offers and/or restrictions.
27. When purchasing a portrait voucher, you agree to be bound by our general portrait booking terms and conditions, which will be sent to you once your portrait booking date has been confirmed, or alternatively are available on request.
